bought a house and 2 lots it was on, sellers agreed on the offer we made if they kept the third lot.?

They now have this lot for sale and according to the lot dimensions part of our house and driveway is on the lot they kept. We did not have a survey done but did go through a title company and paid them. I have found an aerial map online with the lots marked out and it is obvious that the property line runs through our house. What can we do.

  1. First, your title insurance policy won't help. They contain an exception to anything that is shown on a current survey. No survey, no coverage for the problem. Here's the scenario as I understand; you bought 2 lots (let's say 1 & 2) and seller retained lot 3, but part of your home and driveway encroaches onto lot 3. You're going to have to buy that portion of lot 3 that your home and driveway encroaches on. Now if that sale leaves the owner of lot 3 with a lot that isn't a buildable size, then you'll have to buy all of lot 3. If the seller won't sell, then you will have to go to court. It will helpful if you can determine if the seller knew of this problem prior to selling. realtor.sailor
